Southeast Man Charged With Felony DWI
Putnam County Sheriff Donald B. Smith reports the recent arrest of a Town of Southeast man on a felony DWI charge.
On December 24, 2013 at 3:11 a.m., Deputy Sheriff Frederick Mark stopped a speeding motorist on Peaceable Hill Road in the Town of Southeast. The deputy determined that the driver, identified as Erich P. Gertig, Jr., 31, of 5 Spruce Road in the Town of Southeast was intoxicated. The deputy arrested Mr. Gertig and charged him with Driving While Intoxicated, a misdemeanor, after the man failed a series of standardized field sobriety tests. The defendant was processed at the Putnam County Correctional Facility, where his charge was upgraded to Aggravated Driving While Intoxicated. It was further determined that the defendant had been previously convicted of DWI within the past ten years, at which point his charge was upgraded to a felony. The defendant was held pending arraignment.
If found guilty of the felony charge, the defendant could face up to four years in a New York State Correctional facility and a fine of up to $5,000.00.
